BE IT RESOLVED, that this portion of the meeting dealing with the following generally described matters shall not be open to the public: Personnel Matters; Student Matters; Current or Potential Litigation; Matters of Attorney / Client Privilege; Contract and /or Labor Negotiations; and/or Negotiations for Property Acquisitions.

BE IT FURTHER RESOLVED, that it is anticipated that the matters to be considered in private may be disclosed to the public at a later date when confidentiality is no longer required.

BE IT FURTHER RESOLVED, that private consideration is deemed required and is permitted because of the following noted exceptions set forth in the Open Public Meetings Act: (1) Rendered confidential by Federal law or that if disclosed would impair receipt of Federal funds; (2) Rendered confidential by State statute or Federal rule; (3) Would constitute an unwarranted invasion of individual privacy; (4) Deal with purchase, lease or acquisitions of real property with public funds; (5) Related to setting of bank rates or the investment of public funds and disclosure could adversely affect the public interest; (6) Related to tactics and techniques utilized in protecting the safety and property of the public and disclosure may adversely affect the public; (7) Related to investigation of violations or possible violations of the law; (8) Related to pending / anticipated litigation or contract negotiations in which the public body is or may be a party; (9) Falls within attorney-client privilege and confidentiality is required; (10) Deals with personnel matters of public employees and employee has not requested that the matter be made public; and/or (11) Quasi-judicial deliberations after public hearing that may result in imposition of a civil penalty or suspension or loss of a license or permit.

During the course of the Board meeting, the Boonton Board of Education offers members of the public the opportunity to address issues regarding the operation of the Boonton Public Schools. The Board reminds those individual who take this opportunity to identify themselves by name and address and to limit their comments to items listed on the agenda and/or items directly related to the School District.

Issues raised by members of the public may or may not be responded to by the Board. All comments, however, will be considered and a response will be forthcoming if and when appropriate.

The Board asks that members of the public be courteous and mindful of the rights of other individuals when speaking. Specifically, comments regarding students and employees of the Board are discouraged and will not be responded to by the Board as students and employees have specific legal rights afforded by the laws of New Jersey.

The Board bears no responsibility nor will it be liable for any comments made by members of the public; therefore, public members should consider their comments in light of the legal rights of those affected or identified in their comments and should be aware that they are legally responsible and liable for their comments.
